Goods are transported solely at the risk of the client. Liability towards the client/customer is insured in accordance with the CMR Convention of 19 May 1956, unless otherwise agreed in writing.

Any complaints must be submitted in writing no later than 7 days after receipt of the invoice.

In the event of a dispute, only the courts of the judicial district of Turnhout shall have jurisdiction.

Payments must be made in Oud-Turnhout within the payment term stated on the invoice, or, if no term is specified, within eight days of the invoice date.

No set-off may be applied between the freight charges and any amounts that may be owed by the carrier. In the event of non-payment of the invoice on its due date, and without the need for prior notice of default, the outstanding amount shall automatically accrue interest at the reference interest rate established by the European Central Bank (ECB), as provided for in the Belgian Act of 2 August 2002, increased by seven percentage points and rounded up to the nearest half percentage point.

If the debtor remains in default within fifteen days following the dispatch of a registered notice of default, the amount due shall automatically be increased by 10%, with a minimum of €125, as liquidated damages to cover additional administrative costs, debtor follow-up, and debt collection expenses.

The various claims of the carrier against its debtors, even if they relate to different shipments and goods no longer in its possession, shall constitute one single and indivisible claim, for which the carrier may exercise all its rights and privileges.

Furthermore, any goods coming into the possession of the carrier shall serve as collateral for the payment of claims owed by its debtors or by the owner of the goods. This pledge shall be governed by the provisions relating to commercial pledges.

From that moment, the carrier shall be entitled to exercise a right of retention over any goods in its possession.

Should one or more provisions of these General Terms and Conditions be deemed invalid or unenforceable for any reason, the remaining provisions shall remain fully valid and enforceable.
